Presear grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use our services strictly in accordance with these Terms. Our services include but are not limited to our website, SaaS products (Presear ERP, CRM, HRMS, Edu, VMS, QRASO, Labs, Cloud), APIs, and any associated software.
You may use our services for lawful purposes in connection with your business or personal activities, provided such use is consistent with applicable laws and these Terms.
You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit or make available to any third party our services or content without our prior written consent.
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
Presear reserves the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
The Service and its original content, features, and functionality are and will remain the exclusive property of Presear Softwares Pvt Ltd and its licensors. Our trademarks, trade names, logos, and service marks may not be used in connection with any product or service without the prior written consent of Presear.
You retain ownership of any data you submit to our services. By submitting data, you grant Presear a worldwide, royalty-free licence to use, process, and store that data solely for the purpose of delivering the services to you.
You agree not to engage in any of the following activities:
The services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, express or implied. Presear does not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, Presear disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Presear Softwares Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the services.
Our total liability to you for all claims arising from or related to these Terms or the services shall not exceed the amount paid by you to Presear in the twelve (12) months preceding the claim.
We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service will cease immediately.
All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bhubaneswar, Odisha, India.
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide at least 30 days' notice prior to any new terms taking effect by posting a notice on our website. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms.
